Patrick Rapacchiano (plaintiff) Vs. F. Anthony Visceglia (defendant) Defamation Action:

UPDATE AS OF 12/31/2007: Rapacchiano V Visceglia Docket L238-07: Case has been settled outside the Juristiction of the Courts: Defendant paid Judgment and Case has been filed as Satisfied and Dismissed with Prejudice: Plaintiff Rapacchiano through his Attorney Jason lomax, signed a settlement agreement and agreed on a specific dollar amount that defendant would pay plaintiff in this matter. Defendant Visceglia did satisfy Judgment and has been filed so with the courts. This case Can not be re-opened. According to Public Record Documents, The Camden County Sheriff Department had executed and Served Writs of Execution against Defendant Visceglia on 8/24/2007 and a Wage Execution order on 10/23/07:to defendants employer Commerce Insurances, Cherry Hill NJ: Mr. Visceglia is a resident of Blackwood, Camden County New Jersey,Court related Documents remain Public Record indefinately. A Lawsuit was filed today in the Superior Court of New Jersey, Camden County, Civil law division: The Plaintiff in this action is Patrick J. Rapacchiano. The Defendant is Mr. Felice Anthony Visceglia (aka) Anthony Visceglia who resides at 715 Jefferson drive, Blackwood NJ 08012, County of Camden (as listed on pg 1 of Complaint). Visceglia is a former resident of the Bells lake section of Washington Township NJ in the county of Gloucester. Lawsuit lists Three counts against Defendant. Count One- Defamation, Count Two- Breach of Contract, Count Three- Unjust Enrichment. According to Complaint (pgs 2 &3) Plaintiff and defendant were former friends. Plaintiff endured verbally abusive and Unpredictable behavior by defendant Visceglia. Money Loans were exchanged, friendship ended. Defendant refused to repay any money borrowed, In addition, Defendant deliberatly posted false and defamatory comments about Plaintiff accusing him of engaging in Criminal Acts. This was done on part of defendant as an act of retaliation against Mr. Rapacchiano. David Avedissian, esquire filed Lawsuit on behalf of Plaintiff Patrick J Rapacchiano. Court Records indicate that defendant, Mr. Felice Anthony Visceglia, of Blackwood, NJ, County of Camden. A Default Judgment was signed and entered against defendant. Felice Anthony Visceglia, failed to file an answer to the lawsuit. Mr. Visceglia chose not to plead or defend in accordance with the rules of the courts. Defendant defaulted on entire lawsuit. The Courts view a defendants failure to respond to a lawsuit a general admission that allegations are true and have merit. Updated information will be provided as soon as available. The Judgment was filed and signed by Judge Irvin Schiedner. Camden County NJ Superior Court: Law division # L000238-07. All Court related documents are Public Record. These records remain on file indefinately. After about a period of 10 years the County sends all Court records to the archives in Trenton New Jersey. The Records are placed on Microfilm and Magnetic Computer tapes and filed. All Records become a permenant part of an individuals Public Record Profile. Every 30-60 days the Credit Bureau updates their records with information they obtain from Docketed Judgments. Once a Judgment is Docketed it appears on Credit Reports, Backround and Employment checks. Judgments will adversely effect a FICO score.

Docket# L-00023807 Rapacchiano V. Anthony Visceglia (Felice), It has been learned that Judgment was Recorded and Docketed in Trenton NJ. A Docketed Judgment will automatically place a LIEN on any property owned by defendant within the state of New Jersey. Properties can not be sold until Title is cleared. A Damage hearing is pending in this case. Essentially, due to the defendants failure to answer Lawsuit. The Trial that was initially requested by Plaintiff and his Attorney has been reduced to a hearing. The Plaintiff's Attorney need only prove by a likelyhood that the Defamatory messages posted can be linked back to Felice Anthony Visceglia. In some defamation claims you do not need to prove that the Plaintiff was harmed to a significant degree by actions of defendant.

10/23/07: Update: an settlement agreement may be reached between the two parties involved, outside the juristiction of the courts.

As of 11/1/07, it has been learned that a Settlement Agreement has been prepared by Plaintiff Attorney, Jason S. Lomax. Defendant, Anthony Visceglia has agreed to a settlement offer through Plaintiff Attorney Jason Lomax. Both partie's have signed the Agreement. The dollar amount is unclear, however this agreement will close the entire lawsuit case when the payment is made in full. The defamation action was filed against Defendant Anthony Visceglia on January 8, 2007 with the Superior Court of NJ: Camden County: Civil Law Division. Defendant failed to plead or file an answer with the Courts. A Default Judgment was entered on February 28, 2007. A Defamation hearing was due to be scheduled, however since case has been settled, the hearing is not necessary. Initially the Judgment was recorded as a Property Lien in Trenton NJ. The Lien will be removed once the dollar amount of settlement is satisfied. On two occasions since August 2007, Mr. Visceglia has had two (2) Writs of Execution issued against him in an attempt to enforce collection action. First on August 24, in which defendant's Checking account was "frozen" or levied". The second attempt at collection was a wage Garnishment order issued and served to defendants employer on October 23, 2007. The defendant is employed with Commerce Insurance Services, Cherry Hill NJ. Once the garnishment order was issued, defendant Visceglia seemed very eager to settle the entire Lawsuit claim. The garnishment order as well as the Bank levy was served by the Camden County Sheriff department.
